Thank you for visiting the Four Norms ("Four Norms," "we," "us," or "our") website at https://www.fournorms.com (the "Site"). Four Norms mission is to empower parents to reclaim the play-based childhood through collective action, providing the digital tools that connect local parent groups with each other and to national movements to maximize their impact.. We need rules to keep our Site safe for you, us, and other users, and these Terms of Use ("Terms") outline your rights and responsibilities related to our Site and Services (defined below). Acceptance of Terms

Your use of the information, materials, text, images, and tools ("Services") on the Site is subject to these Terms. Please read these Terms carefully. By using the Site and Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

User Accounts

You will need to create a user account ("User Account") to access and use certain parts of, and Services on, our Site. When setting up your User Account, you must provide accurate and complete information, including a valid email address. You are responsible for your User Account and everything that happens on your User Account, including for any harm or damage (to us or anyone else) caused by someone using your User Account with or without your permission. This means you need to be careful with your password and any emails you receive from us. You may not transfer your User Account to someone else or use someone else's User Account without their permission. Inform us immediately upon learning that someone else may be using your User Account without your permission by contacting us as described in Section 13 below.

Organization Accounts

When you sign up for an account for your organization ("Org Account") you will have the ability to invite new users to the organization, remove existing users, moderate the message board (including deleting messages), develop playbooks, message or send emails directly to members, use our CRM tool, and utilize additional Site functionality as it is developed. You are responsible for your Org Account and everything that happens on your Org Account, including for any harm or damage (to us or anyone else) caused by someone using your Org Account with or without your permission. This means you need to be careful with your password and any emails you receive from us. You may not transfer your Org Account to someone else or use someone else's Org Account without their permission. Inform us immediately upon learning that someone else may be using your Org Account without your permission by contacting us as described in Section 13 (How to Contact Us) below.

In using an Org Account, you will have access to certain information (name, email address, city, state, and zip code) of members of your organization. You acknowledge and agree that you are prohibited from retaining, using or disclosing such information for any purpose other than administering your organization and contacting members of your organization.

You understand that Four Norms is not responsible for account administration and internal management of the Services for you. You are responsible for taking necessary steps for ensuring that your organization does not lose control of the Org Account.

Account Termination

You are free to terminate your User Account at any time by contacting us at info@fournorms.com. If you need to delete an Org Account, please contact us at info@fournorms.com.

Data Ownership

Data Ownership Declaration

You retain ownership of all data you submit through our Site and Services, including personal information, documents, and other data inputs. While Four Norms requires a limited license to use this customer data to provide its Services (see Section 6 (Rights and Limits)), such use is strictly for operational purposes and does not affect ownership rights. This Section 5 applies to both regular users and organization account users. Regular users maintain ownership of their individual data submissions. Organization account users own the data submitted and created under their Org Account and may use data submitted or shared with the organization by User Account owners.

Data Export Rights

Users have the right to export their data from Four Norms. This right is subject to certain limitations, such as data that may be restricted due to legal or security reasons. Data can be exported in commonly used formats, such as CSV or JSON, to ensure accessibility and usability.

Process for Data Export

To request a data export, you should contact info@fournorms.com. Requests will be processed within thirty (30) days from the date of receipt. While Four Norms strives to provide this service free of charge, any applicable fees will be communicated upfront. Once exported, customers are responsible for the security and management of their data.

Rights and Limits

Your License to Four Norms

As between you and Four Norms, you own your original content that you submit or post to the Site. Content includes, for example, feedback, group posts, videos, photos, audio, and/or PDFs. You grant Four Norms a non-exclusive, worldwide, transferable and sublicensable right and license to use, copy, modify, distribute, display, host, and process your content and other information without any further consent, notice and/or compensation to you or others. You agree to only provide content and other information that does not violate the law or anyone's rights (including intellectual property rights).

Use of Site Content

The Site and its entire contents, features, and functionality (including but not limited to all information, software, displays, text, images, data, documents, other materials and content (collectively, the "Site Content") is our property and may be protected by copyright and other restrictions. You may not reproduce, copy, modify, distribute, create derivative works of, or publicly display, republish, download, store, transmit, or otherwise use any of the Site Content, except for your personal and non-commercial use. Please note that we may remove Site Content at any time.

Service Availability

We may change, suspend or discontinue the Site or our Services. We may also limit the availability of features, content and other information so that they are not available to all Site visitors (e.g., by subscription access).

Intellectual Property Rights

Four Norms reserves all of its intellectual property rights in the Site and Services. Names, titles, trademarks, service marks, and logos (collectively, the "Trademarks") displayed on the Site are our registered and/or unregistered common law trademarks or those of third parties. Nothing contained in the Site should be construed as granting any license or right to use any Trademark displayed on the Site without our written permission or that of the appropriate third party that owns the Trademark.

Acceptable Use

By using the Site and Services you agree not to:

  • Modify, copy, or resell our Site or its content.
  • Bypass security measures or access restricted areas.
  • Reverse engineer or extract our source code.
  • Use automated tools to gather data from our Site.
  • Introduce harmful software like viruses or malware.
  • Alter any part of the Site or its functionality.
  • Attempt unauthorized access to our systems.
  • Use the Site in ways that could harm or overload it.
  • Violate the intellectual property rights of others.
  • Use our Site Content for commercial purposes or to promote other businesses.
  • Engage in activities that harm, harass or bully others.
  • Exploit or harm minors in any way.
  • Promote illegal activities.
  • Attack the Site with denial-of-service tactics.
  • Engage in conduct that restricts others use or enjoyment of the Site.
  • Use our Services to do anything that is unlawful, misleading, discriminatory, or fraudulent.
  • Violate any laws or regulations.

We have the right, but not the obligation, in our sole and absolute discretion, and without giving you any prior notice:

  • Restrict, suspend, or terminate your access to all or any part of the Services;
  • Change, suspend, or discontinue all or any part of the Services;
  • Refuse or remove any material that you submit to the Services; or
  • Deactivate or delete your User Account and all related information and files in your User Account.

Fees and Payments

The Services may be free, or we may charge a fee for using the Services. If you are using a free version of the Services, we will notify you before any Services you are then using begin carrying a fee, and if you wish to continue using such Services, you must pay all applicable fees for such Services. Please note that any payment terms presented to you in the process of using or signing up for paid Services are deemed part of these Terms.

If you wish to purchase paid Services (the "Purchase"), you may be asked to supply certain information relevant to your Purchase, including, without limitation, your credit card number, the expiration date of your credit card, and your billing address. We use a third-party payment processor, Stripe, to bill you through a payment account linked to your account on the Site (your "Billing Account"). The processing of payments will be subject to the terms, conditions, and privacy policies of Stripe (https://www.stripe.com) in addition to these Terms. By submitting your payment information, you understand that we may share that information with Stripe subject to our Privacy Policy.

Children Under the Age of 13

Our Site is for people who are at least 13 years of age or older. If you are younger than 13, you may not set up an account by yourself. We do not knowingly collect any information from children under the age of 13 without parental consent, unless permitted by applicable law. If we learn that we have collected any information from a child under age 13 without parental consent, we will delete that information as soon as possible.

Warranty Disclaimers

THE SITE AND SERVICES ARE PROVIDED BY FOUR NORMS ON AN "AS-IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

Indemnification

You agree to indemnify, defend and hold Four Norms and its owners, affiliates, suppliers, partners, and agents from and against any claims, demands, losses, damages, or expenses (including reasonable attorneys' fees) harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys' fees) arising from or in any way related to any claims relating to (a) your use of the Site or Services (including any actions taken by a third party using your account), and (b) your violation of these Terms. In the event of such a claim, suit, or action ("Claim"), we will attempt to provide notice of the Claim to the contact information we have for your account (provided that failure to deliver such notice shall not eliminate or reduce your indemnification obligations hereunder).

Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL FOUR NORMS BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF GOODWILL, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, (B) ANY SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY, (C) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) ONE-HUNDRED ($100) DOLLARS OR (II) THE AMOUNTS PAID AND/OR PAYABLE BY YOU TO FOUR NORMS IN CONNECTION WITH THE SERVICES IN THE TWELVE (12) MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM OR (D) ANY MATTER BEYOND OUR REASONABLE CONTROL.

Governing Law and Dispute Resolution

You and Four Norms agree that the laws of the State of Illinois, excluding its conflict of laws rules, shall exclusively govern any dispute relating to these Terms, the Site or the Services. You and Four Norms both agree that all claims and disputes can be litigated only in the federal or state courts in Cook County, Illinois, and you and Four Norms each agree to personal jurisdiction in those courts.

Terms Updates

The "Last updated" date at the bottom of these Terms indicate when it was last revised. Any changes will become effective when we post the revised Terms. Your continued use of the Site and our Services after we post any modifications or updates to the Terms constitutes your acceptance of those changes.
